Except as otherwise provided in this division, the judge who provides an offender or delinquent child with the notices described in division C of this section shall require the offender or delinquent child to read and sign a form stating that all of the information described in divisions C 1 to 3 of this section has been explained to the offender or delinquent child.
In any hearing under this division, the Rules of Civil Procedure or, if the hearing is in a juvenile court, the Rules of Juvenile Procedure apply, except to the extent that those Rules would by their nature be clearly inapplicable.
D "Child-victim offender" means a person who is convicted of, pleads guilty to, has been convicted of, has pleaded guilty to, is adjudicated a delinquent child for committing, or has been adjudicated a delinquent child for committing any child-victim oriented offense. The sheriff or designee shall sign the form and indicate on the form the date on which it is so returned.
A 1 Regardless of when the sexually oriented offense or child-victim oriented offense was committed, if a person is convicted of, pleads guilty to, has been convicted of, or has pleaded guilty to a sexually oriented offense or a child-victim oriented offense or a person is or has been adjudicated a delinquent child for committing a sexually oriented offense or a child-victim oriented offense and is classified a juvenile offender registrant or is an out-of-state juvenile offender registrant based on that adjudication, if the offender or delinquent child is in any category specified in division B 1 abor c of this section, if the offender or delinquent child registers with a sheriff pursuant to section
Effective Date: ; ; ; ; ; SB10 G 1 The department of job and family services shall compile, maintain, and update in January and July of each year, a list of all agencies, centers, or homes of a type described in division A 2 or 6 of this section that contains the name of each agency, center, or home of that type, the county in which it is located, its address and telephone number, and the name of an administrative officer or employee of the agency, center, or home.
B 1 "Sex offender" means, subject to division B 2 of this section, a person who is convicted of, pleads guilty to, has been convicted of, has pleaded guilty to, is adjudicated a delinquent child for committing, or has been adjudicated a delinquent child for committing any sexually oriented offense.
If a residence address change is not to a fixed address, the offender or delinquent child shall include in the registration a detailed description of the place or places at which the offender or delinquent child intends to stay and, not later than the end of the first business day immediately following the day on which the person obtains a fixed residence address, shall register with that sheriff that fixed residence address.
Schilling Jr. Classification is based on the crime the person was convicted of or pleaded guilty to. The department of rehabilitation and correction and the department of youth services are not required to provide the written notice to an offender or a delinquent child and the delinquent child's parents if the attorney general included in the document provided to the particular department under division A 1 a or b of this section notice that the attorney general will be sending that offender or that delinquent child and the delinquent child's parents a registered letter and that the department is not required to provide to that offender or that delinquent child and parents the written notice.
Q "Juvenile court judge" includes a magistrate to whom the juvenile court judge confers duties pursuant to division A 15 of section The sheriff shall not cause to be publicly disseminated by means of the internet any of the information described in this division that is provided by a delinquent child unless that child is in a category specified in division F 1 abor c of this section.
Individual states are required to maintain a statewide sex offender registry as well, a service usually provided by each county's sheriff.
If the court finds that the eligible offender has not satisfied the burden of proof, the court shall issue an order denying the motion. A If an offender or delinquent child is required to register pursuant to division A 2 , 3 , or 4 of section Tier III Sex Offender The term 'tier III sex offender' means a sex offender whose offense is punishable by imprisonment for more than 1 year and; A is comparable to or more severe than the following offenses, or an attempt or conspiracy to commit such an offense: i aggravated sexual abuse or sexual abuse as described in sections and of title 18, United States Code ; or ii abusive sexual contact as described in section of title 18, United States Code against a minor who has not attained the age of 13 years; B involves kidnapping of a minor unless committed by a parent or guardian ; or C occurs after the offender becomes a tier II sex offender.
If the new address is in another state, the person shall register with the appropriate law enforcement officials in that state in the manner required under the law of that state and within the earlier of the period of time required under the law of that state or at least seven days prior to changing the address.
